Disparate impact on protected classes is a fair lending concept that can produce dire results for your bank even though the bank did not intentionally discriminate against any protected class. With the advent of the new civil rights movement, this is the time, more than ever, for your board to be actively questioning how the bank is meeting its fair lending responsibilities.

Dr. Skanderson will explain what disparate impact is, how to identify it, and how to evaluate whether there is a legitimate non-discriminatory business justification for the bank policy or practice. He will also provide advice on identifying red flags and how bank boards should exercise their oversight responsibilities.
